现将《湖南省建立统一企业职工基本养老保险制度的实施意见》和《湖南省城镇私营企业、个体工商户从业人员基本养老保险实施办法》印发给你们,请遵照执行。
建立和实行统一的企业职工基本养老保险制度,既是解决目前存在的基本养老保险企业负担重、统筹层次低、管理不健全等问题的需要,又是建立统一、开放、竞争、有序的劳动力市场的客观要求,意义重大。随着经济结构调整和所有制形式的多样化,加快城镇私营企业和个体工商户
从业人员基本养老保险步伐也势在必行。
统一企业职工基本养老保险制度,进一步扩大养老保险覆盖面,是深化社会保险制度改革的重要步骤,关系到改革、发展和稳定的全局。各级政府要把社会保险事业纳入本地区国民经济与社会发展计划,列入重要议事日程,切实加强领导,制定具体方案,精心组织实施。劳动部门要加
强工作指导和监督检查,及时研究解决工作中遇到的问题。体改、经贸、财政等有关部门要积极配合,确保这项制度的顺利实施。
湖南省建立统一企业职工基本养老保险制度的实施意见
根据《国务院关于建立统一的企业职工基本养老保险制度的决定》(国发〔1997〕26号)精神,结合我省近两年贯彻《湖南省人民政府关于深化企业职工养老保险制度改革的通知》(湘政发〔1995〕18号)和《湖南省城镇企业职工养老保险办法》(省政府令第59号)的
实践,现就全省建立统一的企业职工基本养老保险制度提出如下实施意见:
一、统一企业和职工个人缴纳基本养老保险费的基数和比例。企业缴纳基本养老保险费(以下简称企业缴费)的基数为企业职工个人缴费工资基数之和。职工个人缴费工资基数之和小于统计年报的企业工资总额的,应以统计年报数为企业缴费基数。企业缴费比例,要由目前全省平均2
4.5%的比例尽快并逐步降至20%,即1998年1月起降至22.5%,并在2000年底以前降至20%。在降低企业费率的同时,各地各有关部门要采取措施,积极推进失业、医疗、工伤、生育等项社会保险制度改革。
职工个人缴纳基本养老保险费(以下简称个人缴费)的基数为本人上年度月平均工资。月平均工资应按国家统计局规定列入工资总额统计的项目计算,其中包括工资、奖金、津贴、补贴等收入。月平均工资超过本省上年度职工月平均工资300%以上的部分,不计入个人缴费基数;低
于本省上年度职工月平均工资60%的,按上年度职工月平均工资的60%计算缴费基数。个人缴费比例,1997年为本人缴费工资的4%,以后每两年提高一个百分点,直至8%为止。有条件的地区和工资增长较快的年份,个人缴费比例提高的速度可适当加快。
二、统一基本养老保险个人帐户记入比例。从1998年1月1日起统一按本人缴费工资11%的数额为职工建立基本养老保险个人帐户:个人缴费全部记入个人帐户,其余部分从企业缴费中划入;随着个人缴费比例的提高,企业划入的部分逐步降至3%。1997年底以前已为职工
建立的个人帐户储存额予以保留,并与统一制度后职工个人帐户储存额合并计算。个人帐户储存额,每年参照中国人民银行规定的同期城乡居民存款利率计算利息。个人帐户储存额只用于职工养老,不得提前支取。职工调动时,记入个人帐户的储存额全部随同转移。职工或退休人员死亡,
其个人帐户余额中的个人缴费部分(含本实施意见实施前从用人单位缴纳的养老保险费中按职工本人缴费工资基数划转记入职工个人帐户的部分)可以继承。
三、统一基本养老金计发办法。企业职工达到法定退休年龄,符合国家规定的退休条件且履行了缴费(指单位和个人同时足额缴费,下同)义务,应予办理退休手续。其基本养老保险待遇按以下办法计发:
1、1996年1月1日以后参加工作,缴费年限累计满15年的职工,退休后按月发给基本养老金。基本养老金由基础养老金和个人帐户养老金两部分组成。退休时的基础养老金月标准为本省上年度职工月平均工资的20%,个人帐户养老金月标准为本人帐户储存额除以120。缴
费年限累计不满15年的,退休后不享受基础养老金待遇,其个人帐户储存额一次支付给本人。
2、1996年1月1日以前参加工作、1998年1月1日以后退休且个人缴费和视同缴费年限(以下简称缴费年限)累计满15年的职工,按照新老办法平稳衔接、待遇水平基本平衡等原则,在发给基础养老金和个人帐户养老金的基础上再增加过渡性养老金。过渡性养老金按职工
建立个人帐户前的缴费年限每满一年发给本人指数化月平均缴费工资的1.4%。增加过渡性养老金后仍难以平稳过渡的地、州、市,可另加过渡性调节金予以解决。过渡性调节金的具体数额由各地、州、市按每月不超过130元的标准统一确定,并应从统一制度实施后的第6年起在其后
的10年内逐年减少,直至取消。
在统一制度初期,为了保证职工退休后的基本养老保险待遇水平不降低,可以采取新老办法对比计算的做法。凡按照本办法计发的基本养老金,低于省人民政府湘政发〔1995〕18号文件实施前的老办法(按老办法计发待遇的工资基数,仍应按省人民政府湘政发〔1995〕18
号文件规定封定在1994年底以前)待遇标准的,差额部分予以补齐;高于老办法待遇标准的,统一制度实施当年退休的增加幅度不得超过10%,从第2年至第5年退休的增加幅度每年可递增5个百分点,至第6年不再予限制,同时取消新老办法对比计算的做法。
对缴费年限累计满10年不满15年而已达到法定退休年龄的职工,或缴费年限累计满10年而因病或非因工负伤经县以上劳动鉴定委员会鉴定完全丧失劳动能力的职工,也可按月发给基本养老金。其基本养老金由基础养老金、个人帐户养老金和过渡性养老金三部分组成。
对缴费年限不满10年的,退休后不享受基础养老金待遇,其个人帐户储存额一次支付给本人,有视同缴费年限的,再按其视同缴费年限每满一年发给两个月全省上年度职工月平均工资,同时终止基本养老保险关系。
3、1997年底以前已经退休的人员,仍按国家和省原规定发给养老金。
四、继续完善基本养老金正常调整机制。职工退休后领取的基本养老金,根据全省经济发展情况和养老保险基金的承受能力,原则上每年7月1日按照本省上年度职工平均工资增长率的一定比例调整一次。职工平均工资负增长时不作调整。具体调整办法由省劳动厅在国家政策指导下研
究后报省人民政府批准。
企业离休人员基本离休金的调整办法,按照省委办公厅、省人民政府办公厅湘办发〔1997〕2号文件规定执行。
五、严格退休审批手续。劳动行政部门要认真履行职责,严格执行国家现有的退休政策,各地不得自行放宽条件,任何企业都不得自行办理职工退休审批手续。企业职工凡没有经过当地劳动行政部门办理退休审批手续的一律无效。
六、巩固和提高养老保险社会化程度。在巩固现有统筹层次的基础上,进一步改进完善省级统筹办法,继续坚持全省集中决策,省级调控,分级管理,以地州市为主的原则,强化省级调剂金的收缴,加大省级调控力度,在全省范围内逐步实现统一费率、统一标准、统一管理和统一调剂
使用基金。
七、进一步扩大养老保险的覆盖范围。凡按省人民政府湘政发〔1995〕18号文件规定应参加养老保险而至今尚未参加的城镇各类企业及其职工,必须在1998年底以前参加基本养老保险社会统筹。同时,加快城镇私营企业和个体经济从业人员基本养老保险步伐。
八、提高社会保险管理服务的社会化水平。加快将目前由企业发放养老金改为社会化发放的步伐,积极创造条件将离退休人员的管理服务工作逐步由企业转向社会,减轻企业的社会事务负担。各级社会保险机构要进一步加强基础建设,改进和完善服务与管理工作,不断提高工作效率和
服务质量,促进养老保险制度的改革。
九、加强养老保险基金的收缴和管理。基本养老保险基金实行收支两条线管理,要保证专款专用,全部用于职工养老,严禁挤占挪用和挥霍浪费。基金结余额除预留相当于2个月的支付费用外,应全部购买国家债券和存入专户,严禁投入其他金融和经营性事业。各级政府要高度重视基
金收缴工作,各有关部门要督促企业依法缴纳养老保险费。要建立健全社会保险基金监督机构,财政、审计部门要依法加强监督,确保基金的安全。
十、本实施意见从1998年1月1日起施行,省政府过去有关养老保险的规定与本实施意见不一致的,以本实施意见为准。
本实施意见由省劳动厅负责组织实施和解释。
湖南省城镇私营企业、个体工商户从业人员基本养老保险实施办法
第一章 总 则
第一条 为了保障城镇私营企业、个体工商户从业人员年老退休后的基本生活,根据《国务院关于建立统一的企业职工基本养老保险制度的决定》(国发〔1997〕26号)和《湖南省城镇企业职工养老保险办法》(省政府令第59号)的规定,结合本省实际,制定本办法。
第二条 本办法适用于本省境内的城镇私营企业、个体工商户(以下称“用人单位”)及其业主、雇员和帮工(以下称“从业人员”)。已享受其他法定社会养老保险待遇的人员,不适用本办法。
第三条 基本养老保险属于强制性的社会保险。用人单位及其从业人员必须按照本办法规定参加基本养老保险,缴纳基本养老保险费。从业人员个人享受基本养老保险待遇的权利受法律保护。
第四条 本办法规定的基本养老保险实行用人单位和从业人员分担费用,社会统筹与个人帐户相结合,基本养老保险待遇与用人单位及从业人员个人缴费挂钩的原则。
第五条 县级以上劳动行政部门负责从业人员基本养老保险的行政管理工作。
县级以上社会保险经办机构,具体经办从业人员基本养老保险业务。
工商、税务、物价、交通、公安等部门及个体劳动协会和私营经济协会应积极配合并协助做好基本养老保险费的收缴工作。
社会保障委员会对劳动行政部门及社会保险经办机构执行从业人员的养老保险政策、法规和基金管理情况实行监督。
第二章 基本养老保险费的缴纳
第六条 用人单位及其从业人员基本养老保险费按下列标准缴纳。
(一)用人单位现按其从业人员个人缴费工资基数总和的10%缴纳基本养老保险费,以后每年提高2个百分点,5年内逐步过渡到统一的城镇企业缴费水平。
(二)从业人员暂按个人缴费工资基数的4%缴纳基本养老保险费。1999年调整至5%,以后每两年提高一个百分点,直至达到8%为止。
(三)私营企业从业人员,以上年度本人月实际工资收入作为个人缴费工资基数。本人月实际工资收入低于所在地州市上年度职工月平均工资60%的,以所在地州市上年度职工月平均工资收入的60%为缴费工资基数。本人月实际工资收入超过所在地州市上年度职工月平均工资收入
300%以上的部分,不计入缴费工资基数。
个体工商户从业人员,以所在地州市上年度职工月平均工资作为缴费工资基数。
第七条 基本养老保险费可由用人单位的开户银行代为扣缴(免签协议),或者委托工商、税务等部门代为收缴。用人单位也可以直接向社会保险经办机构缴纳。
第八条 用人单位和从业人员缴纳的基本养老保险费,存入社会保险经办机构在银行开设的“基本养老保险基金帐户”。
第九条 基本养老保险基金实行收支两条线管理,保证专款专用,全部用于养老保险,严禁挤占挪用和挥霍浪费。财政、审计部门要依法加强监督,确保基金安全。
第十条 用人单位缴纳的基本养老保险费在税前列支,从业人员缴纳的基本养老保险费不计征个人所得税。
第十一条 基本养老保险费不实行减免。因特殊原因,用人单位暂无力缴纳的,由用人单位提出书面申请,经当地社会保险经办机构批准可以暂缓缴纳。缓缴期最长不得超过6个月。
第十二条 用人单位在办理工商注册和税务登记后,必须在30日内到当地社会保险经办机构办理基本养老保险登记手续,按时、足额缴纳基本养老保险费。
用人单位未办理基本养老保险登记手续或不缴纳基本养老保险费的,工商、税务、物价、交通、公安等部门在办理有关证、照年检、年审和登记手续时,应督促其办理基本养老保险登记手续和缴纳基本养老保险费。
第十三条 用人单位与从业人员建立、解除劳动关系,或用人单位发生分立、兼(合)并、停业、破产的,应在30日内到社会保险经办机构办理参保、停保、转移等相关手续。
第十四条 社会保险经办机构应当定期对参加基本养老保险的用人单位的从业人员人数、工资总额、退休人数核查一次。核查时,有权调阅用人单位的从业人员名册、帐目和报表,有关部门应予以配合。
第三章 基本养老保险个人帐户
第十五条 社会保险经办机构按照国家技术监督局发布的社会保障号码为每个参加基本养老保险的从业人员建立基本养老保险个人帐户,发给基本养老保险个人帐户手册。
第十六条 个人帐户按本人缴费工资的11%建立,个人帐户由以下部分组成:
(一)个人缴纳的基本养老保险费;
(二)从用人单位缴纳的基本养老保险费中按从业人员本人缴费工资基数的一定比例划入的部分。
随着个人缴费比例的提高,从用人单位划入的部分相应降低,直到降至3%为止。
个人帐户的储存额,每年参照中国人民银行规定的同期城乡居民存款利率计算利息。所得利息记入个人帐户。
第十七条 用人单位缴纳的基本养老保险费,除计入从业人员个人帐户部分外,其余作为社会统筹基金。
社会统筹基金和个人帐户储存额参照中国人民银行规定的同期城乡居民存款利率计算利息。
第十八条 社会保险经办机构每年结算一次个人帐户储存额,并及时向从业人员提供个人帐户对帐单和个人帐户卡,作为从业人员核查和今后享受基本养老保险待遇的依据。
第十九条 从业人员工作异动,个人帐户储存额全部随同转移;因故停止缴纳基本养老保险费的,个人帐户予以保留;继续缴纳基本养老保险费的,个人帐户中的前后储存额予以合并计算,不间断计息。
第四章 基本养老保险待遇
第二十条 从业人员达到退休年龄,男年满60周岁,女年满55周岁,累计缴费年限满15年的,方可办理退休手续,按月领取基本养老金。基本养老金由两部分组成:
(一)基础性养老金。按当地上年度职工月平均工资的20%发给。
(二)个人帐户养老金。标准为个人帐户储存额除以120。
第二十一条 从业人员有下列情况之一的,一次性领取养老保险补助金,同时终止其基本养老保险关系。
(一)从业人员累计缴费年限未满15年即达到退休年龄的,可一次性领取个人帐户中的全部储存额。
(二)退休前或者退休后死亡,其个人帐户储存额尚未领取或未领取完的,其中的个人缴费部分可由其法定继承人一次性领取。私营企业主及个体工商户本人的个人帐户储存额或余额可以全部继承。
(三)从业人员未达到退休年龄而去境外(包括港澳台)定居的,可按本条(二)项的规定一次性领取相应待遇。
第二十二条 从业人员退休后死亡,依照国家和本省有关规定发给的丧葬补助费和供养直系亲属救济费,先从个人帐户储存额中支付,不足部分从社会统筹基金中支付。
第二十三条 从业人员的缴费年限从用人单位和本人缴纳基本养老保险费开始时计算。
从业人员被招收、聘用到国家机关、企事业单位工作,并继续缴纳基本养老保险费的,其实际缴费年限可前后合并计算。
从业人员原在国家机关、企事业单位已建立了个人帐户的,其实际缴费年限前后合并计算。
从业人员参加基本养老保险之后中断缴费期间,不计算缴费年限。
第二十四条 建立基本养老金的正常调整机制。从业人员退休后按月领取的基本养老金按照城镇企业退休人员基本养老金增长比例同步调整。
第二十五条 用人单位和从业人员到社会保险经办机构核查基本养老保险费缴纳和基本养老保险基金支付情况,社会保险经办机构应无偿提供服务。
第五章 附 则
第二十六条 违反本办法有关规定的,依照《湖南省城镇企业职工养老保险办法》(省政府令第59号)处罚。
第二十七条 本办法实施前,已经按照省人民政府有关规定参加基本养老保险的,按照《湖南省建立统一企业职工基本养老保险制度的实施意见》的有关规定予以衔接。
第二十八条 本办法由省劳动厅负责解释。
第二十九条 本办法自1998年1月1日起执行。
